Wellvine provides behavior, environment, and medication tracking, along with summaries intended for review by a qualified clinician. It does not provide a medical diagnosis, treatment, or professional advice, and it is not a substitute for the judgment of a licensed provider. In an emergency, contact your child's provider or emergency services.
1. The Services
Wellvine offers a caregiver tracking and coordination platform, including daily behavior and environment check-ins, a medication tracker, a care team directory, document storage, and generated appointment reports, that helps parents organize information about their child's care between and during provider visits. Features may change over time as we improve the Services.
2. Eligibility and accounts
You must be able to form a binding contract to use the Services and must be a parent, legal guardian, or authorized caregiver of the child whose information you enter. You are responsible for the accuracy of information you provide and for keeping any account credentials secure.
3. Responsibilities of parents and guardians
Ensure a qualified clinician reviews tracked information and generated reports before relying on them for care decisions. Obtain any consents and provide any notices required by law before entering another person's information, including a child's. Use the Services in compliance with applicable laws, including health-privacy rules that may apply to information you choose to store here.
4. Acceptable use
You agree not to misuse the Services, including by attempting to disrupt them, access them without authorization, reverse engineer them, or use them for unlawful purposes.
5. Intellectual property
The Services, including the software, content, and "Wellvine" branding, are owned by Wellvine or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Services as permitted by these Terms. You retain rights to the data you submit.
6. Fees
Where the Services are offered for a fee, the applicable pricing and payment terms will be set out in a separate order or agreement. Unless stated otherwise there, fees are non-refundable except as required by law.
7. Disclaimers
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or that tracked information or generated reports will be accurate or complete in every case.
8. Limitation of liability
To the maximum extent permitted by law, Wellvine will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Services will not exceed the amounts you paid to us for the Services in the twelve months before the event giving rise to the claim.
9. Indemnification
You agree to indemnify Wellvine against claims arising from your misuse of the Services or your breach of these Terms or applicable law.
10. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect the Services or comply with law. Provisions that by their nature should survive termination will survive.
11. Governing law
These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules. The courts located in Colorado will have jurisdiction over disputes, unless applicable law requires otherwise.
12. Changes
We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Your continued use of the Services after changes take effect means you accept the updated Terms.
